Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the services and websites (“Services”) provided by Tip The Web Foundation, Inc (“Tip The Web”). Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms.
Tip The Web offers services for 1) “Tippers”, users who wish to record and support their favorite web content, and 2) Web Publishers who wish to accept Awards from Tip The Web. You can act as both types of user.
You agree that by donating to Tip The Web you expect only that Tip The Web act in accordance with its stated mission as a non-profit entity: to support and encourage the increase of high-quality, freely-accessible content on the Internet. You agree and understand that as a Donation, the monies you Donate to Tip The Web are not refundable.
Tip The Web uses Donations to make Awards to publishers, basing these Awards on the tipping activity of the users of its services (Tippers). You understand that Tip The Web can not provide any guarantee that your Donations will be used to make Awards to a specific person, as neither Tips nor Donations directly identify a person or a potential recipient of an Award. Donating to Tip The Web is similar to Donating to other non-profit organizations, except that Tip The Web provides Services for its donors to direct the organization, via its Tipping Services, in what freely-accessible web content Tip The Web should support.
When a User, signed-in to their Tip The Web Account, makes a Donation to Tip The Web using the Donation Services provided in its Web-Based Application, Tip The Web will make the USD amount of the Donation available to the User to use for Funding their Tips.
You agree that a Tip is not a donation or payment, and understand that it only records a Link or URL to web content (Tip Target) and an Amount between $0.05 USD and $100.00 USD. You understand that such a link or URL (Tip Target) does not directly identify a person or potential recipient of an Award.
Tip The Web classifies Tips in several distinct ways described below. Note: For the purposes of simplicity in Tip The Web’s web-based application, a Tipper’s list of Funded Tips includes Funded Tips which have been Canceled by the User, along with Tips that have been Claimed or Returned during Tip The Web’s processes.
Tippers can create Unfunded Tips using Tip The Web’s Services which simply record the Tipper’s intent to support, at a later point, some web content without backing the Tip with funds from a Donation to Tip The Web. These Unfunded/Pledged/Draft Tips are modifiable by the user, including deletion of the Tip, except for changing the Link/URL of the web content (Tip Target) that the Tip is connected to. Unfunded Tips are only visible to the Tipper and not visible to any other user of Tip The Web’s Services. Tip The Web does not require the Tipper to donate to Tip The Web before making Unfunded Tips; but Unfunded Tips do not count towards or influence Tip The Web’s Award distributions to Publishers.
An Unfunded Tip can stay as an Unfunded Tip, be transitioned by the Tipper to a Funded Tip, or they can be deleted by the Tipper.
Tippers can create Funded Tips directly or Fund previously created Unfunded Tips using Tip The Web’s Services. A Funded Tip is a Tip which has been associated with monies the User previously Donated to Tip The Web. Funded Tips can not be modified by the User in any way, except for being canceled, which transitions the Funded Tip to a Canceled Tip. Funded Tips are visible to other Users of Tip The Web and should be considered public information. You agree and Understand that Tip The Web has the right to display your Funded Tips publicly on its Website.
A Funded Tip can be transitioned by Tip The Web to either a Claimed Tip or Returned Tip. Tip The Web runs a periodic process which analyzes Funded Tips which have been created or Funded by the User for at least 21 Days to determine if the Tip’s Target has been claimed by a Tip The Web User. Funded Tips with a Claimed Tip Target that are at least 21 Days old are transitioned to Claimed Tips. A Funded Tip which does not have a Claimed Tip Target will reside as a Funded Tip for up to 6 Months, giving the rightful owner of the content ample time to Claim the associated Tip Target. At any point the User may choose to Cancel a Funded Tip, which transitions the Funded Tip to a Canceled Tip and allowing the monies associated with the Tip to be reassigned by the User to create new Funded Tips or Fund one or more of their Unfunded Tips.
A Funded Tip with a Multi-Author Tip Target which has not been claimed after 30 days will be assigned to the Tip The Web account which has claimed the entire website. This provides ample time for an author on a multi-author website to claim their web pages on that site, and if they do not do so, the Tips to their content will just be assigned to the site-owner if the whole website domain/hostname is claimed by a Tip The Web account.
A Tipper has the ability to Cancel any of their Funded Tips which are less than 21 Days old. After 21 Days a Funded Tip may only be Canceled if the Tip Target has not been Claimed by a Tip The Web User. When Canceling a Funded Tip, the monies associated with the Tip can be reassigned by the User to create new Funded Tips or Fund one or more of their Unfunded Tips.
Canceled Tips can not be modified by the User and do not count towards or influence Tip The Web’s Award Distributions to Publishers. Canceled Tips are visible to other Users of Tip The Web and should be considered public information. You agree and Understand that Tip The Web has the right to display your Canceled Tips publicly on its Website.
Canceled Tips remain unchanged indefinitely.
A Funded Tip which has a Tip Target that has been Claimed by a Tip The Web User and has been Funded for at least 21 Days is considered a Claimed Tip. A Claimed Tip can not be modified by the Tipper, and a Claimed Tip can not be Canceled. You agree and understand that only the Tips which are Claimed Tips are used by Tip The Web to determine Awards to Publishers. You agree and understand that Tip The Web does not guarantee that the value or monies associated with a Claimed Tip will be Awarded to the User who has Claimed the Tip Target, and Awards to Publishers are under the sole discretion of Tip The Web. Tip The Web has a right and duty to verify that the User who has Claimed the Tip Target has done so in accordance with these Terms and the content associated with the Claimed Tip Target is freely-accessible and does not violate these Terms.
Claimed Tips are visible to other Users of Tip The Web and should be considered public information. You agree and Understand that Tip The Web has the right to display your Claimed Tips publicly on its Website.
A Claimed Tip remains unchanged indefinitely, unless Tip The Web determines the Claimed Tip has a Tip Target which violates these Terms in any way, resulting in the Tip will be transitioned into a Returned Tip.
A Funded Tip which has been Funded for 6 Months and the Tip Target has not been Claimed by a Tip The Web User transitions to a Returned Tip. A Claimed Tip may also transition to a Returned Tip if Tip The Web determines that the content related to the Claimed Tip Target or the process in which the Tip Target was Claimed violates these Terms. Returned Tips are essentially treated similar to Canceled Tips, except that the transition of the Tip occurred because of Tip The Web’s processes and not the Tipper’s actions.
When Tip The Web returns a Tip, the monies associated with the Tip can be reassigned by the User to create new Funded Tips or Fund one or more of their Unfunded Tips.
Returned Tips can not be modified by the User and do not count towards or influence Tip The Web’s Award Distributions to Publishers. Returned Tips are visible to other Users of Tip The Web and should be considered public information. You agree and Understand that Tip The Web has the right to display your Returned Tips publicly on its Website.
Returned Tips remain unchanged indefinitely.
Tip Targets and Claiming
A Tip always contains a Link/URL that identifies a particular resource accessible over the Public Internet via Hypertext Transport Protocol (HTTP). Tip The Web uses a Tip’s Link/URL to derive a Tip Target; an identifier which a User can Claim and Verify ownership of using Tip The Web’s Claiming Services. Typically a Tip Target identifies a whole website based on the website’s Internet Domain/DNS Host Name, or a User account identified by User ID on a popular Internet publishing platforms external to Tip The Web.
Tip The Web uses sound, verification processes built on industry recognized Standards-based technologies for its Claiming Services. You understand and agree that Tip The Web can not be held responsible or liable for damages or potential Award losses from discrepancies related to Tip The Web’s Claiming Services. An Unauthorized Claim using Tip The Web’s Claiming Services of a Tip Target which represents content on the Public Internet which you rightfully own can and should be reported to Tip The Web at: email@example.com. If a Tip Target you have Claimed is subsequently Claimed by another Tip The Web User you will be notified via Email sent to the Email Address associated with your Tip The Web Account.
Tip The Web takes Tip Target Claiming very seriously. The verification processes Tip The Web has in place prevent unauthorized Tip Target Claiming to the best of Tip The Web’s ability. Unauthorized Claiming of a Tip Target which you do not rightfully own the Public Internet content the Tip Target represents is punishable by Termination of your Tip The Web User Account, forfeiting any pending Publisher Awards from Tip The Web.
Multiple Authored Websites
A Tip targeted to an author on a multi-author website will remain
Tip The Web makes Awards to Web Publishers at the end of every Month. These are Monetary Awards based on the Claimed Tips associated with a Publisher’s Tip The Web Account which have transitioned to the Claimed Tip state by Tip The Web’s processes since the last time an Award was given to the Publisher’s Account.
You understand that Awards to Web Publishers are made at the sole discretion of Tip The Web, in accordance with its non-profit mission. You agree that by claiming a site (Tip Target) using the Services that Tip The Web provides does not require Tip The Web to offer you an Award of any kind. When offered an Award, you understand that the Award is a gift to you from Tip The Web, intended to support you in your efforts to continue publishing high-quality, freely-accessible web content.
You agree and understand that eligibility of Tip The Web Awards is determined solely by Tip The Web and requires at least a Tip The Web Account and Claimed Tips, which have been associated with that Account through Tip The Web’s processes, that total at least $0.05 USD. You also agree and understand that violating these Terms can result in a termination of service and your Tip The Web Account, thus forfeiting any Awards from Tip The Web.
A Tip The Web User can redeem an Award using a Redemption option provided by the Services of Tip The Web.
TipTheWeb Funding Balance
All Awards given by Tip The Web with a value between $0.05 USD and $100.00 USD are redeemable instantly by transferring the Award amount to the recipient’s TipTheWeb Funding Balance to use for funding Tips that user makes.
Awards given by Tip The Web with a value between $1.00 USD and $2,500.00 USD are redeemable via PayPal (http://www.paypal.com) using an existing PayPal Account. You agree and understand that by choosing PayPal as the redemption option for an Award that all Claimed Tip Targets (Claimed Sites) associated with your Tip The Web Account must also comply with PayPal’s Acceptable Use Policy (https://cms.paypal.com/us/cgi-bin/?cmd=_render-content&content_ID=ua/AcceptableUse_full). PayPal can not be used as an Award Redemption option if the content you publish that is being Tipped by Users of Tip The Web does not comply with PayPal’s Acceptable Use Policy.
Awards given by Tip The Web with a value over $2,500.00 USD a check can be written and mailed to the recipient.
Tip The Web Services contain links to third-party websites. You agree that Tip The Web is not responsible or liable for the availability or accuracy of such websites, nor for the content, products, or services available from such websites. Links to third-party websites do not imply any endorsement of such websites by Tip The Web. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites.
The Services are Available “AS-IS”
You understand and agree that the Services are provided to you on an “AS IS” and “AS AVAILABLE” basis.
Limitation of Liability
You agree not to hold Tip The Web liable for any damages of any kind resulting from your use of the Services.
Tip The Web may terminate or suspend Services and your Tip The Web account immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms. You agree and understand that termination of your Tip The Web Account forfeits you from receiving or redeeming any Awards from Tip The Web.
Modification of Terms
Tip The Web may revise these Terms from time to time. The current version will always be posted prominently at http://tiptheweb.org/terms/. By continuing to use the Services after those revisions become effective, you agree to be bound by the revised Terms.
